Terms of sale
This English version is provided for convenience. If there is any difference, the Polish version prevails.
1. Seller
The seller and service provider is Tomasz Stenka, a sole trader operating as Colayla, ul. Skarpowa 55, unit 6, 80-145 Gdańsk, Poland, NIP 5833574727, REGON 545292638, registered in CEIDG. Contact: [email protected], +48 784 315 979 (Mon–Fri 9:00–17:00).
2. Definitions
- Seller — Tomasz Stenka.
- Client — a person or organisation placing an order.
- Consumer — a Client who is a natural person entering into the contract for purposes not directly related to their business or profession. Consumer rules also apply to a sole trader for whom the contract is not of a professional nature (Art. 3855 of the Polish Civil Code).
- Product — a newspaper or other print made from the Client's files and specification.
- Design service — layout on a template or a graphic design produced by the Seller.
- Quote — the proposed specification, price, currency and date sent to the Client by email.
- Proof — a PDF showing the Product exactly as it will be printed.
3. Website and form
The website colayla.com presents the Seller's offer and lets you send a quote request. It is not an online shop — you do not order through a basket or pay on the website. Online payments are made only through a secure Stripe link sent after Proof approval (section 5).
The quote form is a free electronic service available to everyone. It requires a browser with JavaScript enabled and an email program. The form prepares an email that you send yourself; you can stop using it at any time. Sending unlawful content is prohibited.
4. Quote, proof and contract
Based on your request the Seller sends a free Quote, valid for 14 days. After receiving the files the Seller checks them free of charge and sends a Proof. The contract is formed when the Client approves the Proof (e.g. by replying by email). By approving the Proof the Client confirms the content, page order and specification of the Product. The Seller confirms the contract on a durable medium (by email), stating the print start date and the expected shipping date.
5. Prices and payment
Prices on the Prices page are indicative and given in Polish złoty (PLN), British pounds (GBP) and US dollars (USD). The amount in the currency stated in the Quote is binding. All prices are final — the Seller is VAT-exempt under Art. 113(1) of the Polish VAT Act. The delivery cost is stated in the Quote.
Payment is made after Proof approval and before printing starts. Business clients with regular orders may, by agreement, pay within 14 days of shipping. Payment methods: online payment via a secure Stripe link (Visa or Mastercard card, Apple Pay, Google Pay, BLIK) and bank transfer. Online payments are processed by Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland. The Seller has no access to full card details and does not store them. Payments appear on statements as COLAYLA. Details: Payments, refunds and cancellation.
6. Files and content
The Client supplies files meeting the requirements under Formats, paper and files. The Client is responsible for the content of the Product and confirms they have the right to use it, including text, photos, images of people and trademarks. The Seller does not review content legally but may refuse to print content that breaks the law or infringes third-party rights — in that case it refunds the full amount paid. The Seller is not responsible for content errors visible in the approved Proof.
7. Printing and turnaround
Digital printing (up to 300 copies) is done by the Seller in Gdańsk within 3 business days of payment being received. Offset printing (from 500 copies) is produced with a partner web-offset printing house within 5–7 business days; the Seller is responsible to the Client for the whole order. The shipping date given in the confirmation is binding. Printing on newsprint has natural qualities: lower colour saturation than on screen or coated paper, a white margin at the edges, and slight shade differences between copies. A run tolerance of ±2% applies to offset printing; the Seller refunds a proportionate part of the price for any missing copies.
8. Delivery
Products are shipped by InPost or a courier within Poland and to European Union countries, with tracking. Free collection in Gdańsk is possible by appointment. The risk of accidental loss or damage passes to a Consumer when the parcel is handed to them. Please check the parcel on receipt and report any damage within 7 days.
9. Cancellation and refunds
The Client may cancel an order at no cost before approving the Proof, and after paying — until printing starts — with a full refund (less only the price of any Design service already performed). Once printing has started, cancellation is not possible unless the Seller misses the shipping date. Refunds are made within 14 days, in the payment currency and using the same payment method the Client used, unless the Client agrees to another method at no cost to them. Before disputing a payment with your bank (chargeback), please contact the Seller — this does not limit your rights.
10. Right of withdrawal
Under Art. 38(1)(3) of the Polish Consumer Rights Act, the right to withdraw from a distance contract does not apply to Products made to the Consumer's specification. The Consumer may, however, cancel the order under section 9. For the Design service, the Consumer has a right of withdrawal under the rules on the Right of withdrawal page.
11. Complaints
The Seller is responsible for the Product's conformity with the contract. Complaints can be made as described on the Complaints page. The Seller replies within 14 days.
12. Liability
Towards Consumers the Seller is liable under the Polish Consumer Rights Act and Civil Code. Towards Clients who are not Consumers, the Seller's liability is limited to the price of the order concerned, except for damage caused intentionally; the Seller is not liable to them for lost profits. This section does not limit Consumer rights.
13. Personal data
The Seller is the controller of personal data. Processing, including of personal data in print files and payment data handled by Stripe, is described in the Privacy policy.
14. Out-of-court dispute resolution
A Consumer may use the out-of-court procedures described on the Complaints page. Using them is voluntary.
15. Final provisions
These Terms are effective from 8 September 2026. They do not exclude or limit Consumer rights under mandatory law. Polish law applies to matters not covered, in particular the Civil Code and the Consumer Rights Act. The Seller may amend these Terms for important reasons; contracts concluded before an amendment remain subject to the Terms in force on the date of the contract.
